These Terms of Service ("Terms") govern your access to and use of the ImageAnimatorAI websites, web applications, APIs, and related services (collectively, the "Service"). By creating an account, initiating a session, or otherwise using the Service you agree to be bound by these Terms and the documents referenced herein. If you do not agree, you must not use the Service.

1. Who we are

ImageAnimatorAI is operated by Image Animator Labs Ltd. ("ImageAnimatorAI", "we", "our", or "us"). We provide AI-powered tools that transform static images into animated media, generate descriptive prompts, and manage user-generated assets.

2. Eligibility & Accounts

You must be at least 16 years old to use the Service. If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian.
You are responsible for maintaining accurate account information, safeguarding login credentials, and notifying us immediately of any unauthorized access.
Accounts may not be shared or resold. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Communications

By creating an account, you agree to receive service-related and administrative communications from us. You may also receive marketing or promotional messages; you can opt out of marketing at any time via the unsubscribe link or your account settings. We may still send non-marketing notices required to operate the Service.

4. Acceptable use

You agree not to:

Upload content that is unlawful, offensive, defamatory, pornographic, or violates any third-party rights.
Attempt to reverse engineer, probe, or disrupt the Service, our infrastructure, or authentication mechanisms.
Circumvent usage limits, queue prioritisation, or billing mechanisms.
Use generated content in violation of applicable laws, regulations, or platform policies where the content is published.
Submit any personal data or sensitive information in prompts or uploads unless you have the legal right to do so.
Use automated systems, bots, or scripts to access, scrape, or abuse the Service.

We reserve the right to remove content, throttle access, or terminate accounts that breach these terms or create security risks.

5. Intellectual property

You retain ownership of the original content you upload.
Generated outputs are assigned to you, subject to any rights granted to third-party model providers or licensors we integrate.
By using the Service you grant ImageAnimatorAI a non-exclusive, worldwide licence to store, process, and transmit your content solely to provide the Service, improve safety systems, and comply with legal obligations.
All software, documentation, and branding associated with ImageAnimatorAI remain our exclusive property. You may not copy, redistribute, or frame them without prior written consent.

6. Copyright complaints

If you believe that content on the Service infringes your copyright or other intellectual property rights, please contact [email protected] with sufficient information to identify the content and your rights. We may remove or restrict access to the content while we review the claim.

7. Plans, payments & credits

Access to certain features requires purchasing credits or subscribing to a plan. Pricing, quotas, and payment methods are documented on the pricing page and may change with prior notice.
You agree to provide accurate billing information and authorize us (and our payment providers) to charge your payment method for fees you incur.
Subscriptions are billed via PayPal. A subscription becomes active only after a successful charge; approval alone does not grant paid access.
Canceling a subscription stops future renewals. You retain access (and subscriber pricing) until the paid-through date, and you may reactivate before that date.
Subscription credits refresh on your billing date (annual plans distribute monthly) and expire at the end of each subscription month. Credit packs are one-time purchases; subscribers receive discounted pricing. Credit packs do not expire.
We consume credits that expire sooner first (typically subscription credits), then credit packs.
Plan changes (upgrades/downgrades) apply on the next billing cycle unless otherwise stated.
Refunds: We do not refund current periods or consumed credits except where required by law. If you believe you were charged in error, contact [email protected] and we will investigate. Refunds/reversals after credits are consumed may result in a negative balance and feature restrictions until cleared.

8. Third-party services & links

The Service may rely on third-party providers (including payment processors and model infrastructure) or link to third-party sites. We are not responsible for third-party services, content, or policies. Your use of third-party services is subject to their terms and privacy policies.

9. Privacy & cookies

Our data handling practices, including how we use cookies and similar technologies, are described in the Privacy Policy, which is hereby incorporated into these Terms. We use essential cookies for security and functionality, and optional cookies for analytics or marketing where permitted by your preferences.

10. Warranties & disclaimers

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Generative outputs are probabilistic and may contain inaccuracies, artefacts, or biased content. You are solely responsible for reviewing, moderating, and using outputs in compliance with applicable laws.

11. Limitation of liability

To the maximum extent permitted by law, ImageAnimatorAI, its affiliates, directors, employees, and licensors are not liable for any indirect, incidental, consequential, punitive, or special damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability arising out of or related to the Service shall not exceed the greater of (a) the amounts you paid within the 3 months preceding the claim, or (b) USD $50.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless ImageAnimatorAI and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Suspension & termination

We may suspend or terminate your access, with or without notice, if we suspect a breach of these Terms, detect fraudulent activity, or are required to do so by law. You may terminate your account at any time via the account dashboard or by contacting support. Sections intended to survive termination (e.g., IP, payment obligations, warranties, liability, indemnification) will remain in effect.

14. Governing law & dispute resolution

These Terms are governed by the laws of Singapore, without regard to its conflict-of-law rules. Any dispute arising out of or relating to the Service shall be resolved through final and binding arbitration administered by the Singapore International Arbitration Centre (SIAC). Proceedings will be conducted in English with one arbitrator. Notwithstanding the foregoing, either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.

15. Changes to these Terms

We may update these Terms to reflect operational, legal, or regulatory changes. Updates will be posted on this page with a revised effective date. Material changes will be communicated in-app or via email. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
